Tax evasion and tax avoidance are two distinct concepts with different legal implications.

Tax evasion refers to the illegal act of not reporting or underreporting income to the tax authorities, or of claiming false deductions or credits, in order to reduce tax liabilities. Tax evasion is a criminal offense and is punishable by fines, imprisonment, or both.

Tax avoidance, on the other hand, refers to the legal use of tax laws and regulations to reduce tax liabilities. Tax avoidance involves structuring financial and business affairs in a way that minimizes tax liabilities, within the bounds of the law. Tax avoidance is generally acceptable, as long as it does not involve engaging in illegal activities or exploiting loopholes or ambiguities in the tax law.

However, the line between tax avoidance and tax evasion can be blurred, and tax authorities may challenge tax avoidance schemes that they consider to be aggressive or abusive. In these cases, the courts may decide whether the tax avoidance scheme was legal or whether it constituted tax evasion.
